General Terms and Conditions
Right of Use
The client grants the artist a right of use to the photos or image files that serve as the basis for the artwork to be created. This right of use includes the processing of the image files, the creation of drafts and sketches, as well as photographs of the same and the created artwork. The client assures the artist that the submitted photos or image files are free of third-party rights. In the event that third parties assert rights to the submitted photos or image files against the artist, the client indemnifies the artist from all third-party claims.
Fee
To place a binding order for a portrait, the full fee must be paid in advance. Upon conclusion of the contract, 50% of the fee is due immediately. Payments can be made by direct bank transfer to the bank account specified in the artwork contract. Two weeks before work begins, the client will receive an email from the artist. The remaining 50% of the fee is then due immediately. Please note that orders are processed upon receipt and that the waiting time can be up to four months, or six months during peak periods. Please contact us to ensure that a portrait can be completed and delivered at your desired time. If the gift is for a special occasion, a gift certificate can be used to bridge the gap. Packaging and shipping costs vary depending on the size, framing, and recipient’s destination and will be invoiced separately. Shipping will occur immediately after these costs have been paid.
Shipping
All orders are shipped securely with a tracking number to the address provided by the client. If the artwork is a gift,
it can be shipped directly to the recipient. The recipient’s address must be provided when ordering.
Goodwill
The client has a 7-day money-back guarantee from the date of payment of the initial deposit. Cancellations must be made via email.
Gift Certificates
Gift certificates can be purchased for partial or full payment for the artwork to be created. Gift certificates are valid for 12 months from the date of purchase. They can be redeemed for any type of commissioned work. Gift certificates cannot be exchanged for cash; they are linked to the creation of a commissioned work.
Damage During Shipping
All finished works of art are packaged with the utmost care to protect them from impact or color abrasion. The packaging process is documented with photos, from the finished artwork through all stages of packaging to the condition of the package ready for shipment. The package is wrapped in a film indicating careful handling of fragile goods. Should damage occur during transport or delivery due to improper handling, the shipping company must be contacted, providing the tracking number. For large-format works framed behind glass, we recommend that you pick them up in person or have them shipped by a company specializing in artworks. The customer bears the costs for this.
Waiting Time
The list of artworks to be created is a waiting list, to which each order is added after receipt of the first payment. Depending on workload, the completion of a work can take four to six months. For special occasions or urgent requests, individual works can be brought forward, although waiting times may occur towards the end of the year or during the summer break.
Data Protection
Customers’ personal data will not be sold, distributed, or leased to third parties.
VAT and Import Duties
Annely’s Animals’ artworks are not subject to VAT. In some countries, import duties may apply, which are the sole
responsibility of the customer.
